1. Resident understands and agrees that the online payment option is voluntary and provided for the resident’s convenience and used at the resident’s sole discretion.
2. Resident understands and agrees that traditional forms of rent payment such as hand delivery and mailing of rent are still available.
3. Resident understands and agrees that the online payment option does not absolve resident from paying rent timely and in full in the event this option is unavailable due to maintenance, outages, or other service interruptions.
4. Resident understands and agrees that EVERCREST Development & Management (EVERCREST D&M), EVERCREST D&M affiliates, and landlords are not associated with Zego® and that Zego® is a third-party service provider.
5. Resident understands and agrees that EVERCREST D&M, EVERCREST D&M affiliates, landlords, and Zego® are not responsible for resident fund and/or banking institution delays, stop payments, and errors.
6. Resident understands and agrees that the landlord or landlord’s agent is not required to accept the rent payment tendered by a third party unless the third party has provided to the landlord or landlord’s agent a signed acknowledgment stating that they are not currently a tenant of the premises for which the rent payment is being made and that acceptance of the rent payment does not create a new tenancy with the third party. Failure by a third party to provide the signed acknowledgment to the landlord or landlord’s agent shall void the obligation of a landlord or landlord’s agent to accept a tenant’s rent tendered by a third party.
7. Resident understands and agrees that resident is disallowed from using the online payment option within three months of a resident’s Non-Sufficient Funds (NSF) check submission.
